Booking Terms & Conditions

 

Please read the following terms and conditions carefully. You must not accept any booking unless you understand and agree with the following terms and conditions.

 

The Contract – Clients of Your Holiday Your Way (YHYW) must agree to the total itinerary to be planned and booked with Your Holiday Your Way. After we have received your base payment ($250) and we have issued a confirmation notice, a contract will exist between you and Your Holiday Your Way in respect to the planning, research, online resources and tailored itinerary provided. Upon the booking and payment of individual components, clients of YHYW and each of the suppliers will enter into separate contracts, effective from the date printed on your component invoices. The terms and conditions of each supplier you have booked with will apply to your booking. Once the contract is made, the airlines, accommodation provider and any other supplier is responsible for providing you with what you have booked.

 

The contract reads as follows

I have read, understood and accepted the booking terms and conditions on the Your Holidays Your Way (YHYW) website on behalf of all parties noted on this form, by whom, I am authorised to make this agreement. I agree to pay the base fee of $250 to YHYW within 5 business days from today. I understand that YHYW will tailor a holiday package for me and that all booked components (with the assistance of YHYW or otherwise) will contribute towards the Total Holiday Cost and be used for calculating any additional fees owed to YHYW as per the fee schedule.

 

Liability – Your Holiday Your Way is only acting as an agent we have no liability in respect of the supply of any element of your booking, including any liability for illness, personal injury, death or loss of any kind, delay and inconvenience caused directly or indirectly by any provider of travel services or products or by other third parties unless caused by our negligence. Any claim for damages for injury, illness, loss or death must be brought against the relevant supplier of the travel services or products.Your Holiday Your Way assist you in arranging travel services with suppliers such as airlines, tour and cruise operators, car hirers and accommodation providers. In doing so Your Holiday Your Way gives no warranty, nor makes any representation regarding the services to be supplied or the products purchased by you. Your booking will be subject to the terms and conditions applied by the provider of the service or products. You agree that if the travel services or products are not supplied in accordance with your booking your remedy lies with the service provider and not Your Holiday Your Way.

 

Airline Baggage allowances -Baggage allowances (both checked and hand-luggage) vary between specific airlines and routes flown. Your Holiday Your Way will advise you of the allowance based on the specific airlines web-site. You will be charged for any excess over your free allowance. To increase your safety, there are rules for taking liquids, aerosols and gels in hand-luggage, these rules are needed to protect you from the threat of liquid explosives.

 

Airfare Conditions - Many airfares are subject to strict conditions regarding amendments, cancellations and refunds. In addition airlines impose taxes fees and charges. It is your responsibility to ensure the type of airfare you purchase is suitable for your needs, including but not limited to class of travel, luggage entitlements, in-flight service entitlements and number of stops.

 

Airline Schedules - The airline on which you are booked may change its departure time. It is your responsibility to contact the airline to check there has been no change to the time of departure. Your Holiday Your Way will endeavour to contact you as soon as your schedule changes as a courtesy.

 

Airline Taxes and Fuel Surcharges - All airfares are subject to taxes and charges levied by both government and airlines; in addition global fuel costs are constantly fluctuating. Airlines pass on the increase in taxes and fuel surcharges without notice and whilst we will endeavour to advise you of these charges in advance that may not always prove possible. The price is only guaranteed when paid in full.

 

Airline tickets - International and domestic airlines have replaced paper tickets with electronic tickets called e tickets. All passengers travelling on an e ticket will be required to produce photo identification at check in. Your Holiday Your Way will provide copies of all e-tickets in your travel compendium.

 

Cancellation Fees - If you cancel your booking you may incur cancellation charges. The amount of this charge will vary depending on when the cancellation is made and the terms and conditions of the supplier of travel services or product. If you are entitled to a refund, this will NOT be provided by Your Holiday Your Way, but is the legal responsibility of each of the travel suppliers through which your bookings were made. Your Holiday Your Way will charge a cancellation fee per booking as set out in the attached schedule of fees.

 

Changes to your itinerary - If you decide to change any part of your booked itinerary, Your Holiday Your Way will do all we can to help. However, the suppliers are under no obligation to make any change, although with reasonable notice (six weeks or more), changes may be possible. Be aware that the supplier may not honour prices or deals that were available at the original time of booking and that any additional costs for supplementary fares/tariffs and change fees are your responsibility. Your Holiday Your Way will NOT charge any administration fees per booking as do most travel agents.

 

Health - It is your responsibility to ensure that you are aware of any health requirements for your travel destinations and to ensure that you carry all necessary vaccination documentation.

 

Itinerary and documentation:

 

Check your itinerary – As clients of Your Holiday Your Way must ensure that all names and titles are the same as in your valid passport. Check the accuracy of all dates and timings. Any errors on your documents will be your responsibility if not brought to the attention of Your Holiday Your Way prior to travel.

 

Documentation - As a general rule, your Travel Compendium with hard copies of all travel documents will be available for collection or delivery approximately two weeks prior to departure, this will vary depending on your individual arrangements. It is your responsibility to arrange collection of all travel documents from us prior to travel.

 

Passports & Visas - It is your responsibility to ensure that you have valid passports, visas and re-entry permits which meet the requirements of immigration and other government authorities. Any fines, penalties, payments or expenditures incurred as a result of such documents not meeting the requirements of those authorities will be your sole responsibility.All travellers must have a valid passport for international travel and many countries require at least 6 months validity from the date of entry. Your Holiday Your Way will advise you of visa and other travel document requirements for your trip. We will obtain such information and advice from an external visa advisory service provider on your behalf. We do not warrant the accuracy of such information and accept no liability for any loss or damage, which you may suffer in reliance on it. We can obtain visas for you if you wish and fees will apply for this service.

 

Prices - All prices are subject to availability and can be withdrawn or varied without notice until full payment is made with the relevant suppliers.

 

Special Requirements – It is your responsibility to advise us of any special requirements you may have: child meals, seating requests, medical requirements, etc. If you wish to gain mileage points from your airfare it is your responsibility to advise us of your frequent flyer numbers or enquire about any memberships and to check that the fares being booked will or will not earn mileage points.. Boarding passes and ticket copies should be kept until points appear on your membership statement.

 

Travel Documents - Travel documents include (without limitation) airline tickets, hotel vouchers, tour vouchers or any other document (whether in electronic form or otherwise) used to confirm an arrangement with a service provider. Travel documents may be subject to certain conditions and/or restrictions including (without limitation) being non-refundable, non-date-changeable and subject to cancellation and/or amendment fees.

 

Travel Insurance - Travel insurance is strongly recommended by the Department of Foreign Affairs and Trade for all overseas travel. Your Holiday Your Way strongly recommends that you take out comprehensive travel insurance at the time of paying a deposit. The policy should provide cover for loss of deposit, cancellation and additional expenses, medical expenses and repatriation and loss or damage to baggage and valuables. You are responsible for making any special or increased insurance arrangements which you deem are necessary. If you decline travel insurance, you automatically acknowledge the inherent risks and financial repercussions that exist and acknowledge that Your Holiday Your Way is not financially liable for any such event and subsequent financial burden.

 

General Terms- Your Holiday Your Way reserves the right to alter these terms and conditions at any time.

 

Governing Law - Your contract with Your Holiday Your Way is governed by the laws of the State of Queensland and you agree to submit to the jurisdiction of the courts of Queensland to determine any dispute pertaining to the contract.

 

Definitions

We” and “us” means Your Holiday Your Way, Sole Operator Bruce Stevens ABN 80808809317.

You” means any user of this Website and includes any person who acquires a Travel Product.

Planning Services” means services provided by us to you in assisting you to acquire a Travel Product from a Third Party Travel Provider and includes advisory and consulting services, making this Website and any software associated with it available to you, and providing a facility to enter into transactions with us and Third Party Travel Providers (whose details and Travel Products appear on this Website and other Websites).

"TOTAL Holiday Cost" is equal to the sum of all components listed on your itinerary for which a reservation has been made via a contract with the supplier and secured by way of credit card, deposit, part payment or payment in full and is regardless of whether the booking of the component was completed with the assistance of YHYW or otherwise.

Travel Provider” means the company or person who provides you with the Travel Product on terms and conditions agreed with you.

Travel Product” means the service or product provided by a Third Party Travel Provider, for example, an airline or a hotel.“Website” means this website.

 Schedule of Fees

As per the customer contract, Your Holiday Your Way will assist with ALL bookings for the itinerary and as such, the TOTAL Holiday Cost of all bookings will determine the final payment owing to Your Holiday Your Way. Remember that we will plan your holiday with you and endeavour to find the best prices on the internet for the components of your holiday.

 

The base fee of $250 will be charged at the first consultation, this fee will cover the planning services provided as per

"What We Do" ..

 

This base fee is non-refundable as considerable time is spent by Your Holiday Your Way in sourcing the elements of your holiday and designing your online resources. It should be noted that some travel agents have 'Consultation Fees' set at $99 / hour.

 

Additional fees may be payable to Your Holiday Your Way based upon your TOTAL Holiday Cost. This TOTAL Holiday Cost is equal to the sum of all components listed on your itinerary (regardless of whether the booking was completed with the assistance of YHYW or otherwise). The amount of any additional fee owing to YHYW will be calculated on he TOTAL holiday cost  using the YHYW fee structure.  upon completion of the planning of your final Itinerary. Any additional fees must be paid in full at the handover of your travel compendium.

 

Cancellation Fees: Should you cancel your holiday prior to completion of the compedium, Your Holiday Your Way will retain the base fee and calculate additional fees due based on the TOTAL Holiday Cost at the time of the cancellation. Any fee outstanding above the base $250, must be paid in full. You will of course retain the planned itinerary and have full access to your web page should you resume your holiday plans at a later date.

 

NOTE: Your travel insurance policy may assist you in recovering some of these fees if their terms and conditions include cancellation fees.

 

Your Holiday Your Way reserves the right to apply to above, service fees in addition to those by airlines, tour operators and other services providers that you may use as part of your travel arrangements handled by Your Holiday Your Way
